🇺🇸The SEC said that tokenized securities are divided into two categories: those created by the issuer and those created by a third party.
Tokenized securities created by the issuer will be treated the same as traditional securities.
Tokenized securities created by a third party may not provide holders with rights to the underlying securities and, in some cases, may be classified and regulated as security-based swaps.
So security-based swaps are typically subject to stricter reporting and capital requirements
